Payment Terms: Due upon completion of work, unless otherwise noted in the Special Terms.  Special Terms can only be approved by an officer of Leinbach Services Inc. prior to start of work. In case of non-payment, Leinbach Services shall have the right to seek and collect any and all costs, damages and remedies provided by applicable law, including, but not limited to , the total price of work performed (parts, equipment, labor, transportation, etc.) any and all attorneys’ fees and court costs. Billing for work by Leinbach Services includes a service charge and travel time from Leinbach Services shop to and from customer’s location (not including stops for rest breaks, meals, etc).   For commercial customers, mileage is charged at $1.00/mile to and from customer location and there is not a service charge. Work requested that is not in the scope of the work order will be billed in accordance with our rate schedule (your technician can provide you a copy of our rate schedule). Rates will be rounded up to the nearest 1/2 hour. Customer shall pay a service charge of $30.00 per returned check and 2% per month on all outstanding balances. MasterCard and VISA accepted-An additional charge of $4.00 will be added to the total price for processing fee. Parts and equipment installed by Leinbach Services are warranted by the manufacture and Leinbach Services Inc., its employees and its subcontractors are not responsible for the warranty in any way.  Refer to the manufacturer’s warranty for coverage, terms and conditions.Work performed by Leinbach Services, considered unacceptable by the customer, will be corrected at a mutually agreed upon time by Leinbach Services at no charge. This rework is the customer’s sole remedy.

Any suits or claims arising regarding work completed shall only be brought forth in the State or the Federal Courts, specifically the Sixteenth circuit, Eastern District. Tennessee law shall govern any and all agreements without regard to the principles of conflicts of law. Customer hereby consents to personal jurisdiction of the Tennessee courts and waives any defenses based upon improper or inconvenient venue.
